Please read these Terms and Conditions (“Terms”, “Agreement”) carefully before accessing or using FluxGeeks AI (the “Platform”), accessible at www.fluxgeeks.com (the “Site”). This Agreement sets forth the legally binding terms and conditions governing your access to and use of the Platform and all content, features, and services available therein.

By accessing the Site in any manner — whether by browsing, reading, or using any content or prompts provided thereon — you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must discontinue your use of the Site immediately.

1. Acceptance of Terms

FluxGeeks AI provides a free, publicly accessible platform that curates and publishes premium AI-generation prompts for image creation, video transformation, and content production. No user account or registration is required to access the Platform.

Your access to and continued use of the Site constitutes your unconditional acceptance of, and agreement to be bound by, these Terms and Conditions, including any modifications that may be made from time to time. These Terms apply to all visitors, users, and other persons who access or use the Site, regardless of the manner or duration of access.

2. Eligibility and Age Requirements

The Platform is intended for use by individuals who are at least thirteen (13) years of age. By accessing or using the Site, you represent and warrant that:

You are at least 13 years of age;
If you are between 13 and 18 years of age, you have obtained the consent of a parent or legal guardian to access and use the Platform;
You have the legal capacity and authority to enter into this Agreement; and
Your use of the Platform does not violate any applicable law or regulation in your jurisdiction.

FluxGeeks AI does not knowingly collect or solicit personal information from children under the age of 13. If it is discovered that a child under 13 has accessed the Platform in violation of these Terms, we reserve the right to take appropriate remedial action, including blocking access from the relevant source.

3. Intellectual Property Rights

3.1 Ownership of Platform Content and Prompts

All content published on the Platform, including but not limited to the text, scripts, written descriptions, creative structures, phrasing, and compositional elements of the AI prompts provided (collectively, the “Prompt Content”), constitutes original creative and intellectual work. All such Prompt Content is and shall remain the exclusive property of FluxGeeks AI and/or its licensors, and is protected by applicable copyright laws, international intellectual property treaties, and all other relevant laws.

FluxGeeks AI expressly reserves all rights not expressly granted under these Terms. Nothing in this Agreement shall be construed as transferring, assigning, or licensing to you any ownership rights in or to the Prompt Content.

You are strictly prohibited from engaging in any of the following acts without prior written authorisation from FluxGeeks AI:

Copying, reproducing, or duplicating any prompt or portion thereof for distribution or public use;
Selling, reselling, sublicensing, or otherwise commercialising our prompt text or scripts as your own product or service;
Publishing, redistributing, or republishing our prompt content on any other platform, website, marketplace, or media channel;
Presenting or representing any FluxGeeks AI prompt as your own original work; or
Incorporating our prompts into any competing product, service, database, or compilation without express authorisation.

3.2 User Ownership of Generated Outputs

Notwithstanding the foregoing, FluxGeeks AI acknowledges and respects your creative rights with respect to the media and content you independently produce. When you use a prompt sourced from the Platform as an input in a third-party AI tool (such as Midjourney, DALL-E, Stable Diffusion, RunwayML, or similar services), the resulting output — including generated images, videos, audio, text, or any other media — is the product of your own action and, subject to the terms of the relevant third-party AI tool, you retain full ownership of and responsibility for such generated outputs.

For the avoidance of doubt, FluxGeeks AI makes no claim of ownership over any media or content you generate using our prompts as a creative input. The ownership restrictions set out in Section 3.1 above pertain solely to the text and script of the prompts themselves, not to any downstream creative outputs produced by you.

4. Permitted Use and Prohibited Conduct

4.1 Permitted Use

Subject to your compliance with these Terms, FluxGeeks AI grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the prompts on the Platform for your personal, non-commercial creative purposes, including:

Generating images, videos, or other media using the prompts as creative inputs in third-party AI tools;
Using generated outputs for personal projects, portfolios, or non-commercial creative endeavours; and
Sharing generated outputs (i.e., the media you create, not the prompt text itself) on personal social media or similar channels.

4.2 Prohibited Conduct

You agree that you will not, under any circumstances, use the Platform or any prompts sourced therefrom to:

Generate, distribute, or facilitate any content that is illegal, unlawful, fraudulent, or deceptive under any applicable law or regulation;
Generate sexually explicit, pornographic, or obscene content of any kind, including content involving or depicting minors in any sexualised manner;
Generate content that promotes, incites, glorifies, or facilitates violence, self-harm, terrorism, extremism, or hatred against any individual or group;
Generate content that harasses, bullies, defames, or otherwise harms any identifiable individual or organisation;
Generate content that infringes upon the intellectual property, privacy, or other rights of any third party;
Generate disinformation, propaganda, or deepfake content intended to deceive or mislead;
Attempt to circumvent, disable, or interfere with any technical measures or security features of the Platform;
Use automated bots, scrapers, or crawlers to extract prompt content from the Platform in bulk; or
Engage in any other conduct that, in the sole judgment of FluxGeeks AI, is harmful, offensive, or contrary to the spirit and intent of this Platform.

FluxGeeks AI reserves the right, in its sole discretion, to restrict access to the Platform for any user or source that it reasonably believes has engaged or is engaging in prohibited conduct.

5. Disclaimer of Warranties

THE PLATFORM AND ALL PROMPT CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

To the fullest extent permitted by applicable law, FluxGeeks AI expressly disclaims all warranties, including but not limited to:

Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement;
Any warranty that the prompts will produce specific, satisfactory, or commercially viable outputs in any third-party AI tool;
Any warranty that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components;
Any warranty regarding the accuracy, completeness, reliability, or suitability of any content on the Platform; and
Any warranty that the Platform will meet your specific requirements or expectations.

The performance and results of AI generation are inherently variable and dependent on the capabilities, policies, and algorithms of the third-party AI tools you choose to use. FluxGeeks AI has no control over such tools and makes no representations regarding the quality, legality, or appropriateness of any content they may generate.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLUXGEEKS AI, ITS OWNERS, OPERATORS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, HOWSOEVER ARISING, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, business opportunities, or goodwill;
Any harm, offence, or damage caused by content generated by you or any third party using our prompts;
Any claim arising from your misuse of the Platform or violation of these Terms;
Any loss of data or failure of the Platform to function as expected;
Any third-party conduct, actions, or content linked to or arising from use of the Platform; or
Any reliance placed by you on any information or content provided on the Platform.

You expressly acknowledge and agree that FluxGeeks AI bears absolutely no responsibility or liability for the final outputs, generated media, or consequences arising from your use of our prompts in any third-party AI tool. The entirety of responsibility for such outputs, including their legal compliance and ethical appropriateness, lies with you.

In jurisdictions that do not allow the exclusion or limitation of certain types of liability, the foregoing limitations shall apply to the maximum extent permitted by applicable law.

7. Indemnification

You agree to defend, indemnify, and hold harmless FluxGeeks AI and its owners, operators, affiliates, licensors, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your access to or use of the Platform or any prompt content;
Any content you generate, publish, distribute, or otherwise produce using prompts from the Platform;
Your violation of these Terms and Conditions or any applicable law or regulation;
Your infringement of any intellectual property, privacy, or other rights of any third party; or
Any claim by a third party resulting from your use or misuse of the Platform.

FluxGeeks AI reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with us in asserting any available defences.

8. Third-Party Links, Tools, and Advertisements

The Platform may contain hyperlinks, references, recommendations, or advertisements relating to third-party websites, AI tools, services, and platforms (collectively, “Third-Party Services”). These links are provided solely for your convenience and informational purposes.

FluxGeeks AI does not endorse, control, monitor, or assume any responsibility for the content, privacy policies, terms of service, practices, or reliability of any Third-Party Services. You acknowledge and agree that:

Your access to and use of any Third-Party Service is entirely at your own risk;
FluxGeeks AI shall not be liable for any loss or damage suffered by you as a result of your use of or reliance on any Third-Party Service;
Any transactions, interactions, or agreements entered into between you and any third-party provider are exclusively between you and that provider; and
Advertisements appearing on the Platform are provided by independent advertising networks, and FluxGeeks AI is not responsible for the accuracy or content of such advertisements.

We encourage you to review the terms and privacy policies of any Third-Party Services you access through or in connection with the Platform.

9. Privacy and Data

As a public platform that does not require user registration or account creation, FluxGeeks AI collects minimal user data. Any personal data that may be incidentally collected through standard web server logs, analytics tools, or advertising networks is subject to our Privacy Policy, which is incorporated herein by reference.

By using the Platform, you consent to the collection and use of information in accordance with our Privacy Policy. To the extent that any advertising services or analytics tools operating on the Platform collect data about your browsing behaviour, such collection is governed by the privacy policies of those respective third-party providers.

10. Copyright Complaints and DMCA Notice

FluxGeeks AI respects the intellectual property rights of third parties and expects users to do the same. If you believe that any content appearing on the Platform infringes upon a copyright you own or control, please notify us in writing with the following information:

A description of the copyrighted work you claim has been infringed;
A description of the content on our Platform that you claim is infringing, with sufficient detail to locate it;
Your contact information, including name, address, telephone number, and email address;
A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law; and
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner’s behalf.

11. Modifications to the Platform and Terms

11.1 Changes to Terms

FluxGeeks AI reserves the right, in its sole and absolute discretion, to modify, update, revise, or replace these Terms and Conditions at any time and without prior notice. Any changes will become effective immediately upon being posted to the Site.

It is your responsibility to review these Terms periodically. The “Last Updated” date at the top of this document will reflect the date of the most recent revision. Your continued use of the Platform following the posting of any revised Terms constitutes your acknowledgment and acceptance of the changes. If you do not agree to the revised Terms, you must discontinue your use of the Site.

11.2 Changes to the Platform

FluxGeeks AI reserves the right at any time and without notice to modify, suspend, or discontinue the Platform or any portion thereof, including any features, content, or service offerings. FluxGeeks AI shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

12. Severability

If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal, void, unenforceable, or contrary to applicable law, such provision shall be deemed severed from this Agreement to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect and shall be binding upon the parties.

In such circumstances, the invalid or unenforceable provision shall be modified and interpreted in a manner that most closely reflects the original intention of the parties, consistent with applicable law.

13. Entire Agreement and Waiver

These Terms and Conditions, together with any other policies or legal notices published by FluxGeeks AI on the Platform (including the Privacy Policy), constitute the entire agreement between you and FluxGeeks AI with respect to your use of the Platform and supersede all prior and contemporaneous understandings, agreements, representations, or warranties, whether oral or written, relating to the same subject matter.

The failure of FluxGeeks AI to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision, nor shall it preclude FluxGeeks AI from subsequently enforcing such right or provision. No waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorised representative of FluxGeeks AI.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms and Conditions and any dispute, controversy, or claim arising out of or in connection with them, or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions.

14.2 Jurisdiction

You agree that any legal action, proceeding, or dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of Sri Lanka. By using the Platform, you irrevocably submit to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such action in Sri Lanka.

14.3 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact FluxGeeks AI in writing and attempt to resolve any dispute informally through good-faith negotiations. The parties shall endeavour to resolve any dispute within thirty (30) days of written notice, unless a shorter period is required by applicable law or urgent circumstances.
